Course Description: Prepare for FinCEN's 2026 Residential Real Estate Rule. Learn about required data for entities/trusts, payment reporting, filing deadlines, designation agreements, recordkeeping, and penalties. FinCEN’s new Residential Real Estate Rule is coming and this webinar is all about the practical “what do we actually put on the report?” details.
In this session, you’ll learn how to:
1. Understand how the Real Estate Report is organized and what each section is asking for
2. Identify the required information for:
- Reporting Person
- Transferee (entity vs. trust) + Signing Individual
- Transferor (individual/entity/trust)
- Property details
- Payments and the nontraditional lending (hard money/private loan) indicator
3. Know the filing basics (what/where/when) and how to avoid deadline surprises
4. Use designation agreements correctly (what must be in writing, and what needs to be retained)
5. Understand recordkeeping expectations and the penalties framework, including the risks around handling sensitive personal information
