Update on PLTA v. East Stroudsburg School District
A number of members have inquired about the current effect of the decision PLTA won in the Commonwealth Court in the litigation against the East Stroudsburg School District. While the Commonwealth Court issued a strong opinion in PLTA’s favor which requires the return of all real estate tax records to the county Tax Claim Bureaus, the effect of that opinion remains "stayed," during the appeal period. Because the defendants have appealed the Commonwealth Court's decision to the Pennsylvania Supreme Court, the appeal period has not yet ended. The Pennsylvania Supreme Court does not automatically accept all appeals; instead, the initial step of the appeal is one in which the Court decides if it will even hear the appeal. PLTA’s Brief in Opposition to the appeal was filed on February 7, 2007. The Court could take weeks or months to decide whether it will accept the case. We will continue to vigorously pursue this case and will keep you advised of our progress.
